Whilst some believe that the Spanish Tax Authority might have been easily fooled in the past, that is not the case now. The reality is that for a tax debt to be ’statute barred’, the period is longer than 4 years. Hacienda have strong and far-reaching investigative powers these days. Resources are very serious indeed about collecting Succession Tax when it is due. At Legal4spain, we would never recommend such evasive measures, simply because they are unwise, as well as unnecessary. There are totally legal and legitimate ways to reduce your tax exposure by planning ahead. Not to mention, the benefit of helping you sleep at night without fearing Hacienda’s knock at your door!

How important is your N.I.E.?

In relation to estates with Spanish assets, the Spanish N.I.E. (Número de Identificación de Estranjeros) number is the foreign individual’s fiscal identity number. If you have a Spanish property and/or a bank account, you will probably already have this number so you do not need to take any action. Otherwise, it should be applied for as soon as possible. Also, any beneficiaries, who are intended to inherit Spanish assets under your will, require an N.I.E. number. It is highly advisable for all beneficiaries to have N.I.E. numbers at the earliest stage possible- i.e. during the lifetime of the testator, as this speeds up the probate process and can therefore significantly reduce costs and the likelihood of delays.
